PRACTICE EXPERIENCE
Walter Whitman Moore is a trial lawyer. For over 25 years, Mr. Moore has successfully represented businesses and individuals in state and federal courts, and in arbitration. Mr. Moore has represented clients in disputes involving claims for breach of contract, trademark infringement, misappropriation of trade secrets, copyright infringement, wrongful termination, trespass, fraud, unfair competition, undue influence, and breach of fiduciary duty.


Mr. Moore's clients have come from a wide variety of industries, including entertainment, software, banking, real estate, franchising, outdoor advertising, retail, aviation, banking and telecommunications. Besides commercial disputes, Mr. Moore also handles probate cases concerning wills and trusts.

  • Entertainment: Bench trial decision invalidating the multi-million dollar liquidated damages clause in a famous entertainer's confidentiality agreement.
  • Intellectual Property: Summary judgment for the defendants in an action for software copyright infringement.
  • Real Estate: Jury verdict for the defendant billboard company in an action for breach of lease and trespass.
  • Contracts: Preliminary injunction, upheld on appeal, to prevent university from selling historic garden that it had promised to preserve in perpetuity.
  • Personal Injury: Jury verdict for defendant fast food restaurant in personal injury action filed by elderly man who broke his hip on the premises.
  • Trade Secrets: Jury verdict for employer against former employees for misappropriation of trade secrets. Probate: Bench trial decision for defendant trustee in probate trial where plaintiffs claimed they had signed agreement with deceased for 50% ownership in commercial building.
  • Alter Ego: Bench trial decision against a corporation, and its shareholder on alter ego theory, for breach of warranty for an air pollution "scrubber" machine.
  • Fraud: Jury verdict for $6.6 million, including $3.3 million in punitive damages, against a Texas oil man for fraud in the sale of natural gas.
  • Arbitration: Award for $1.2 million in corporate "squeeze-out" case involving American subsidiary of Japanese manufacturer.
  • Writs and Appeals: Writ of mandate vacating Superior Court order compelling judicial reference.
